Actually we know almost nothing about the kings war against the witches or even how he got the sword, he most likely took it as a prize, it only says in Cinderfrost that the war haunted him and was the first step to his madness. Unfortunately the magic advisor who also helped the king with military decisions in Cinderfrost that the king later burned alive doesn't say anything about what lead to the war with the witches, he does imply the king wasn't bad till after the war. Also since the sword trapped souls when the king used it why not when the female thief used it on the guards at the fort. Since the witch can wield the sword without consequence the witches most likely made the sword and somebody who makes a sword that can steal, trap, and exchange souls probable isn't the most noble people. As for the rebels the betrayal at the peace meeting in Silk Sash, using thief's, killing unarmed prisoners, and using the bodies of friends and family against their own, in short nobody's has the moral high ground in this story the king or rebels. Still I look forward to seeing how this plays out Demicoeur said it was only a few more pages.
